Leave, RDOs & public holidays

Under the National Employment Standards (NES), as part of the Fair Work Act 2009, legal standards apply to employees in the private sector, which cannot be reduced by awards or enterprise agreements. These include an employee's entitlement to leave, RDOs and public holiday pay.

Leave

An employee’s entitlement to leave arises from legislation and modern awards, enterprise agreements or transitional instruments, and/or specific contract of employment provisions as set out in a letter of offer or letter of appointment.

The National Employment Standards (NES) under the Fair Work Act 2009 prescribe that employees are entitled to minimum amounts of leave.
