An employee’s entitlement to leave arises from legislation and modern awards, enterprise agreements or transitional instruments, and/or specific contract of employment provisions as set out in a letter of offer or letter of appointment.

The National Employment Standards (NES) under the Fair Work Act 2009 prescribe that employees are entitled to minimum amounts of leave including:

The NES applies to employees employed in the private sector. Where an employee is covered by an award or agreement granting more than the NES the employee receives the higher entitlement.
